Allahabad High Court: Slum policy benefits not for those who filing GST and Income Tax returns.
The Lucknow bench of the Allahabad High Court has clarified that individuals with commercial establishments in slum areas cannot benefit from the state government’s Slum Policy 2021.
The bench, presiding over the Akbarnagar demolition case, emphasized that such individuals cannot be equated with “slum dwellers” and their cases will be considered based on their specific circumstances. Justices Vivek Chaudhary and OP Shukla instructed the state government, LDA (Lucknow Development Authority), and the petitioners to provide a list of slum dwellers who file GST and Income Tax returns, along with details from the last two years.
Around 800 petitioners in the case, argued vigorously that since the state government formulated the Slum Policy in 2021, it must adhere to its provisions and cannot evict Akbarnagar dwellers without following the policy guidelines.
