Unclear Notices: High Court Summons GST Officials

The Gujarat High Court has recently demanded the presence of three senior officials from the state and central GST departments. The issue at hand is the cryptic nature of notices issued regarding the cancellation and suspension of GST registrations. The officials assured the HC to comply with its order over the issue and then the court disposed of the matter.

A Bhavnagar-based firm challenged an order from the Central GST department’s Bhavnagar unit, which cancelled their GST registration without allowing time for a response. The company was expected to reply to the notice on the same day it was received, prompting them to seek relief from the Gujarat High Court.

​During the hearing, Sukhjit Kumar, Commissioner of the Bhavnagar CGST unit, stood before Justice Bhargav Karia and Justice Niral Mehta on Thursday. The court expressed its frustration with the department’s failure to follow guidelines on proposed cancellation of registrations and cautioned it will issue contempt notices.
